The Website jewisheritage.org has been created and is operated by AEPJ for informational purposes, in particular to promote and disseminate its activities relating to Jewish culture and heritage, facilitate contact with institutions and individuals, and enable users to subscribe to news and information concerning initiatives promoted by AEPJ. The domain name jewisheritage.org is registered for and used by AEPJ.

USE OF THE WEBSITE

This Legal Notice (hereinafter, the “Legal Notice”) sets out the terms governing access to and use of the information and services made available by AEPJ through the Website.

Access to and use of the Website are subject to this Legal Notice and, where applicable, to any specific terms, instructions or notices relating to particular services or content available through the Website. Users (hereinafter, the “User” or “Users”) are therefore requested to read this Legal Notice carefully.

Access to the Website is free of charge, except for any costs associated with connecting to the telecommunications network through the User’s internet or telecommunications provider.

AEPJ reserves the right to modify or update the Website, its content, configuration or presentation, as well as this Legal Notice, at any time. Any amendments to this Legal Notice will take effect from the date on which they are published on the Website. Users are therefore encouraged to review the Legal Notice periodically.

Users undertake to use the Website and its content in a lawful and appropriate manner and not to use it for fraudulent or unlawful purposes or in any manner that may infringe the rights or legitimate interests of AEPJ or third parties. In particular, Users must not remove, circumvent or manipulate copyright notices, rights-management information, technical protection measures or other identification or protection mechanisms incorporated into the Website or its content. Users must also refrain from any action intended to damage, disable, overload or impair the Website or interfere with its normal operation or use.

Where AEPJ reasonably considers that a User has breached this Legal Notice or has used the Website unlawfully or improperly, AEPJ reserves the right, where appropriate and technically possible, to restrict, suspend or terminate that User’s access to the Website and to take any other measures reasonably necessary to protect the Website, AEPJ or third parties.

USER REGISTRATION

Access to the information and part of the contents shown on the Web does not require registration by the Users.

INTELLECTUAL AND INDUSTRIAL PROPERTY

All intellectual property rights relating to the Website and its contents, including, where applicable, copyright and related rights, database rights, rights in its graphic design and layout, trademarks, logos, trade names and other distinctive signs, software and source code, as well as texts, photographs, graphics, audiovisual materials and other elements forming part of the Website, are owned by AEPJ or are used by AEPJ under the corresponding licences, authorisations or other rights of use.

Access to or use of the Website does not grant Users any ownership, licence or other intellectual property right over the Website, its contents or AEPJ’s distinctive signs, except to the extent expressly provided otherwise.

Except where permitted by applicable law or expressly authorised by AEPJ or the relevant rights holder, Users may not reproduce, modify, distribute, publicly communicate, make available, extract, reuse or otherwise exploit all or part of the Website or its protected contents.

In particular, the reproduction, use or exploitation of Website content for commercial purposes is prohibited unless prior authorisation has been obtained from AEPJ or the relevant rights holder.

Nothing in this Legal Notice shall restrict any use of protected material that is permitted under applicable copyright or intellectual property legislation.

LIMITATION OF LIABILITY

Users access and use the Website at their own responsibility. AEPJ endeavours to ensure that the Website and its contents are accurate, secure and available; however, it cannot guarantee the uninterrupted availability of the Website or the absence of errors, technical failures or harmful components.

To the fullest extent permitted by applicable law, AEPJ shall not be liable for any loss or damage arising from the use of, or inability to use, the Website, except where such liability cannot lawfully be excluded or limited, including in cases of wilful misconduct or gross negligence on the part of AEPJ.

In particular, and to the extent permitted by applicable law, AEPJ shall not be liable for:

  • Third-party websites: the content, availability, accuracy or operation of third-party websites accessible through links included on the Website. The provisions concerning external links set out in the following section of this Legal Notice shall also apply.
  • Viruses and other harmful components: damage to Users’ devices, systems, software or data caused by viruses, malware, Trojan horses or other harmful components that may arise in connection with access to or use of the Website. Users are responsible for maintaining appropriate security, antivirus and other protective measures on their devices and systems.
  • Technical interruptions: any interruption, suspension, delay or failure affecting access to the Website resulting from telecommunications networks, internet service providers, hosting services or other systems or services provided by third parties outside AEPJ’s reasonable control.

Nothing in this Legal Notice shall exclude or limit any liability of AEPJ that cannot be excluded or limited under applicable law.

EXTERNAL LINKS

The Website includes, or may include, hyperlinks to websites, pages, platforms or other online resources operated by third parties (hereinafter, “External Sites”).

AEPJ does not control External Sites and is not responsible for their availability, operation, content, accuracy, legality, security, terms of use or privacy practices. The inclusion of a link to an External Site does not, unless expressly stated otherwise, imply any endorsement, recommendation, sponsorship, partnership or association between AEPJ and the operator of that External Site.

Users access and use External Sites at their own discretion and are encouraged to review the applicable terms of use, privacy policies and other legal information of such sites.

If a User considers that a link included on the Website directs to unlawful, inappropriate or otherwise harmful content, they may notify AEPJ at communication@jewisheritage.org. AEPJ will assess such notifications and may remove or disable the relevant link where it considers this appropriate or where required by applicable law. The submission of a notification does not in itself require AEPJ to remove the link.

Third parties may link to publicly accessible pages of the Website provided that such links are made lawfully and fairly and do not:

  • falsely suggest any association, approval, endorsement or sponsorship by AEPJ;
  • use AEPJ’s name, trademarks, logos or other distinctive signs in a manner that infringes AEPJ’s rights;
  • present AEPJ’s content in a misleading or deceptive manner; or
  • circumvent any access restrictions or technical protection measures implemented on the Website.

AEPJ reserves the right to request the removal of any link to the Website that infringes these conditions or otherwise violates applicable law.

AEPJ makes reasonable efforts to ensure that the Website is accessible, functional and secure and that Users can browse it under appropriate technical conditions. However, AEPJ cannot guarantee that the Website will operate without interruption or error on every device, operating system, browser or browser version.

Except where expressly authorised by AEPJ or permitted under applicable law, Users must not decompile, reverse engineer, modify, adapt, translate, sublicense, distribute or create derivative works from software or other technical elements forming part of or necessary for the operation of the Website.

Users must not remove, alter, circumvent, disable or interfere with any security measure, technical protection mechanism or access-control system implemented on the Website.

To the extent permitted by applicable law, AEPJ shall not be liable for technical problems or loss or damage resulting solely from the use of obsolete, unsupported or incompatible browsers, software, operating systems or devices. Users are responsible for maintaining reasonably up-to-date software and appropriate security measures on the devices they use to access the Website.

APPLICABLE LAW AND COMPETENT COURTS

This Legal Notice and the use of the Website shall be governed by and construed in accordance with the laws of the Grand Duchy of Luxembourg, without prejudice to any mandatory provisions of applicable national or European Union law.

Any dispute arising in connection with the Website or this Legal Notice shall be subject to the jurisdiction of the competent courts in accordance with applicable law. Where a User qualifies as a consumer, nothing in this Legal Notice shall deprive that User of any mandatory rights or protections, including those relating to applicable law and jurisdiction, to which they are entitled under Luxembourg or European Union law or, where applicable, the law of their country of habitual residence.

If any provision of this Legal Notice is found by a competent authority or court to be invalid, unlawful or unenforceable, that provision shall be deemed severed or, where appropriate, interpreted or replaced to the minimum extent necessary to make it valid and enforceable. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions.
